Delgado & Fernández, LLC Secures Two Major Wins in Court
This week, Delgado & Fernández, LLC achieved an important victory for Pan American Properties Corp., reinforcing the public policy protections afforded to Puerto Rico’s distributors under Act 75.
In an intense litigation that reached the Puerto Rico Court of Appeals, our firm successfully defended Pan American’s rights as the exclusive distributor of Fireball Cinnamon Whisky on the island — a brand they built from the ground up since 2013.
In its ruling, the Appeals Court upheld the injunction prohibiting global brand owners Sazerac Company, Inc. and the interfering distributor, CC1 Beer Distributors, Inc., from selling competing Fireball Cinnamon Malt Beverage products during the ongoing litigation. The panel recognized Pan American’s decade-long efforts, significant investments, and the clear evidence of unfair interference that undermined their exclusive distribution rights.
This decision not only protects our client’s market and contractual rights but also affirms the public policy behind Act 75: ensuring fair treatment and stability for Puerto Rico distributors that create and grow markets for global brands in the island.
In another case and after a week-long trial in the Puerto Rico trial court, Delgado & Fernández, LLC’s litigation team obtained another important victory. Our client prevailed and the Court ordered the specific performance of a purchase and sale agreement executed for the purchase of a real estate property between our client and the defendants. In a reasoned judgment, the Court also provided that, the alternative that specific performance is not possible, damages exceeding the sum of $2.5 million, including economic damages, mental anguish, pre-judgment interests, costs and attorneys’ fees be awarded to our client, after a finding of temerity on defendants’ behalf.
